The state Court of Appeals last week upheld the two first degree criminal sexual conduct convictions of Earl J. Raffler, but struck down one aspect of the scoring system for the sentencing and said a second aspect should be reconsidered by a Macomb County judge.
The decision came after the appeals court previously rejected Raffler motion for a new trial because the victim recanted her testimony. She signed an affidavit attesting to her reversal.
Assistant Macomb County Prosecutor Betsy Mellos in February had argued the girl was pressured to recant, noting Anabolic Steroids Injection Side Effects that two family members had supported the defendant during his trial.

The victim testified that one penetration could have occurred outside the five year time period, the appeals court says.
If he wins that ruling, his guideline range would drop to 51 to 85 months, Bremer said.
It was not clear whether the girl would be able or agree to testify at a hearing. Faunce could rule based on further arguments and a review of transcripts.
